By accessing or using ProdUp ("Service"), you agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use our Service.

Service Description

ProdUp is an AI-powered platform that helps you create and manage Shopify stores. Our services include product import, AI image generation, content enhancement, page building, and direct publishing to Shopify.

Account Registration

To use our Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account.

Subscription & Billing

ProdUp offers subscription plans billed through Stripe:

• Subscriptions are billed on a recurring basis (monthly or annually)
• You may cancel your subscription at any time through your account settings
• Refunds are provided in accordance with our refund policy
• Unused credits do not roll over to the next billing period
• We reserve the right to change pricing with reasonable notice

User Content & Ownership

• You retain ownership of all content you create using our Service, including AI-generated images
• You grant us a license to store and process your content as necessary to provide the Service
• You are responsible for ensuring you have the right to use any source materials

Acceptable Use

You agree not to use the Service to:

• Generate illegal, harmful, or offensive content
• Infringe on intellectual property rights of others
• Create misleading or fraudulent content
• Attempt to abuse or exploit the Service
• Interfere with the operation of the Service

We reserve the right to suspend or terminate accounts that violate these guidelines.

Intellectual Property

The ProdUp name, logo, and all related technology are owned by us or our licensors. You may not use our branding without prior written permission. The Service and its original content, features, and functionality are protected by international copyright, trademark, and other intellectual property laws.

Third-Party Integrations

Our Service integrates with third-party platforms such as Shopify. Your use of these integrations is subject to the respective third-party terms of service. We are not responsible for the availability, accuracy, or policies of third-party services.

Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may modify, suspend, or discontinue features with or without notice. We are not liable for any interruptions or changes to the Service.

Limitation of Liability

To the maximum extent permitted by law, ProdUp shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Service.

Indemnification

Termination

We may terminate or suspend your account at any time for violations of these Terms. Upon termination, your right to use the Service will immediately cease. You may also delete your account at any time through your account settings.
